I think you might be right.
If I remember correctly, a perpetual check is a loss for the player giving the checks. It's only a draw if no checks are involved.
@test123 I thought if a check was anywhere in the repeating sequence, it's considered "perpetual check". I guess I'd have to review the rules in a bit more detail.
According to what I researched it is only considered a perpetual check when the position (where the king is in check) appears for the fourth time from consecutive checks since it appeared for the first time on the board.
